These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and Bizflix Global Private Limited ("Bizflix", "we", "us", or "our"), governing your access to and use of the platform available at bizflix.site (the "Platform").
By registering for an account, accessing, or using our Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.
Bizflix provides a cloud-based SaaS platform that enables businesses to manage, automate, and scale their WhatsApp-based communications. Features may include contact management, message automation, broadcast messaging, conversation management, and analytics, as made available by Bizflix from time to time.
We reserve the right to modify, update, or discontinue any feature or aspect of the Platform at our discretion, with reasonable notice where practicable.

5.1 Subscription Fee: Access to the Bizflix Platform is offered on a subscription basis at a flat rate of USD $8 per month per account ("Subscription Fee"). This fee covers access to the Platform features as made available during your subscription period.
5.2 Billing: Your Subscription Fee is billed monthly on the date you first subscribe ("Billing Date"). Subsequent charges will be made on the same date each month unless you cancel before the next Billing Date.
5.3 Payment: All payments are due in advance and must be made using an accepted payment method as listed on the Platform.
5.4 Taxes: The Subscription Fee is exclusive of any applicable taxes, including GST or other indirect taxes. Where applicable, taxes will be added to your invoice and are your responsibility to pay.
5.5 Price Changes: We reserve the right to change the Subscription Fee at any time. We will provide at least 30 days' written notice before any price change takes effect.
If Bizflix offers a free trial, it will be subject to the terms communicated at sign-up. At the end of the trial period, your account will automatically transition to a paid subscription unless you cancel before the trial ends.
7.1 Cancellation by You: You may cancel your subscription at any time through your account settings or by contacting us at support@bizflix.site. Cancellation takes effect at the end of your current billing period.
7.2 No Refunds: All Subscription Fees are non-refundable. We do not offer pro-rata refunds for unused portions of a billing period, including in the event of early cancellation.
7.3 Cancellation by Bizflix: We reserve the right to suspend or terminate your account and subscription if you breach these Terms, fail to make payment, or engage in any activity that we reasonably determine to be harmful, unlawful, or in violation of WhatsApp's usage policies.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not use the Platform to:
As a Customer, you are solely responsible for:
10.1 Our IP: All rights, title, and interest in and to the Bizflix Platform are and remain the exclusive property of Bizflix Global Private Limited.
10.2 Licence to You: We grant you a limited, non-exclusive, non-transferable licence to access and use the Platform solely for your internal business purposes.
10.3 Your Content: You retain ownership of all content and data you upload or transmit through the Platform.
Each party agrees to keep the other's confidential information strictly confidential and not to disclose it to any third party without prior written consent.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by applicable law, Bizflix's total cumulative liability to you shall not exceed the total Subscription Fees paid by you in the three (3) months immediately preceding the event.
You agree to indemnify, defend, and hold harmless Bizflix Global Private Limited from and against any claims arising out of or related to your use of the Platform.
The Platform may integrate with or depend upon third-party services. Bizflix is not responsible for the availability, accuracy, or practices of any third-party service.
Bizflix may suspend or terminate your access to the Platform at any time, with or without notice, for a breach of these Terms or failure to pay.
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.

These Terms of Service are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.
